BIDDING/CONTRACT/SETTLEMENT MANAGEMENT

Phoenix Consulting helps clients manage risk exposure, and efficiently resolve disputes, through assistance with:

Competitive RFPs/RFOs. We are familiar with common bid-assessment criteria and can advise clients on bid structure and content, to maximize their chances of short-list bid selection by the Buyer.
Negotiation of Power Purchase Agreements (PPAs). We have extensive knowledge of the standard California Investor-Owned Utility (IOU) standard pro forma contracts and have advised numerous clients throughout the negotiation process and can:
 
>  Explain different provisions of those contracts and their implications; and
 
>  Recommend amendments to avoid harm or mitigate risks to clients.
Settlement negotiations for billing or other contract disputes. We have facilitated negotiation of complex bilateral or multiparty agreements between parties with divergent interests, through individual negotiations and settlement conferences/workshops.
